What is the DOT cutoff for a BAT test?

Under 49 CFR Part 40, a BAC of 0.04 or higher is a DOT violation. A result between 0.02 and 0.039 triggers a removal-from-safety-sensitive duty requirement but is not a violation. A second confirmation test is required for any result of 0.02 or higher.

Can a BAT test be used for a court program or DUI diversion?
